Today Judge Hurd in the N.D.N.Y. granted Moore Kuehn’s motion for class certification.
The class action asserts various claims on behalf of student loan borrowers. The court appointed Moore Kuehn with co-counsel as class counsel acknowledging our substantial class litigation experience. See decision below.
The motion for class certification, vigorously opposed by the defendant loan servicer, was granted in less than four weeks after the motion was briefed. Deciding what is likely to be a dispositive motion so quickly is highly unusual and telling of the court’s view towards loan servicers which may skirt their duties. We will continue to fight hard for all consumers victimized by loan servicers and large corporations.
